Individual Sales Agreement

This agreement is concluded electronically between the SELLER and the BUYER under the terms below. By confirming the order, the BUYER is deemed to have accepted all terms of this agreement.

Article 1 — Parties

Buyer: The customer placing the order (“BUYER”). The BUYER’s name, address, phone and e-mail are collected electronically during the order. By confirming the order, the BUYER accepts the obligation to pay the order amount and any additional fees.

Article 2 — Definitions

Law: Consumer Protection Law No. 6502,
Regulation: Regulation on Distance Contracts,
Service: The transport/transfer service subject to sale,
Site: The SELLER’s website www.sgatour.com.tr.

Article 3 — Subject of the Agreement

The subject of this agreement is to determine the rights and obligations of the parties under the Law and the Regulation, regarding the sale and performance of the service whose qualities and price are stated, ordered electronically by the BUYER through the SELLER’s Site.

Article 4 — Service and Payment Details

The essential qualities, quantity, sales price (including taxes) and payment method of the service ordered electronically are as stated on the order screen and in the confirmation e-mail. Announced prices and commitments are valid until updated; prices announced for a limited period are valid until the end of that period.

Article 5 — General Provisions

The BUYER declares that they have read and understood the preliminary information on the essential qualities, price, payment and performance of the service, and have given the necessary electronic confirmation.
The SELLER agrees to perform the service in full and in accordance with the qualities stated in the order.
If performance becomes impossible, the SELLER agrees to notify the BUYER in writing within 3 days and to refund the amount collected within 14 days.
Performance requires electronic confirmation of this agreement and payment of the price by the BUYER’s chosen method. If the price is not paid or is cancelled in bank records, the SELLER’s obligation to perform ends.

Article 6 — Right of Withdrawal

For distance contracts concerning the provision of services, the BUYER has the right to withdraw within 14 (fourteen) days from the date the contract is concluded, without giving any reason and without paying any penalty. To exercise this right, written notice must be given to the SELLER at info@sgatour.com.tr or by registered mail within this period. The SELLER must refund the total amount collected within 14 days of receiving the withdrawal notice.

Article 7 — Cases Where Withdrawal Cannot Be Exercised

Under the Regulation, the right of withdrawal cannot be exercised for services that must be provided on a specific date or period — such as accommodation, transport, catering and leisure services. Accordingly, for transfer and tour services with a set performance date/time, the right of withdrawal cannot be exercised when less than 6 hours remain before the service begins.

Article 8 — Resolution of Disputes

For disputes arising from this agreement, within the monetary limits announced by the Ministry of Trade, the Consumer Arbitration Committees and Consumer Courts at the place where the BUYER purchased the service or resides are competent.

Article 9 — Entry into Force

This agreement, consisting of 9 (nine) articles, has been concluded by being read by the parties and confirmed electronically by the BUYER, and has entered into force immediately.
